Social security law
The Norwegian welfare system is built on the principle that everyone should have financial security throughout the different phases of life - from birth to death. NAV administers comprehensive benefit schemes that are intended to catch those who need help, whether it concerns unemployment, illness, disability, or other life situations. But behind this basic security lies one of society's most complex regulations. The welfare system is regulated by countless laws, regulations, circulars and EU directives that interact with each other in complex ways. The National Insurance Act alone contains hundreds of sections with associated regulations, and new amendments are being made continuously. The NAV system is largely based on automated assessments and standardized procedures. Although this streamlines case processing, it also means that individual conditions and special circumstances can be overlooked.
1
Parental allowance
2
Disability insurance
Disability benefits require medically and occupationally justified reduction in work capacity. We assist in documenting the impact of health problems on work capacity, challenging NAV's work capacity assessment and ensuring correct calculation of the degree of disability. Many are denied or receive a lower degree of disability than they are entitled to because the case is not sufficiently documented or legally justified.
3
Unemployment benefits
The unemployment benefit scheme has strict requirements regarding qualifying periods, membership in the National Insurance Scheme and genuine job search. We help with documentation of employment, handling rejections based on insufficient qualifying periods and guidance on duties as a job seeker. Particularly challenging are cases involving atypical employment conditions, deductibles or conflicts over the amount of unemployment benefit.
4
Work clarification allowance
AAP is a temporary benefit for people with reduced work capacity who are undergoing work-related measures. We assist in documenting activity requirements, handling time restrictions and ensuring a proper transition to other benefits. Many lose AAP due to formal errors or do not receive follow-up adapted to their health situation.
5
Basic and auxiliary benefits
Basic benefits and assistance benefits compensate for extra expenses and the need for practical assistance as a result of a permanent illness or injury. We help document the need for assistance, challenge NAV's functional assessment and ensure correct rates. The scheme requires detailed documentation of daily functions, and many are rejected because the need for assistance is not presented correctly.
6
Sick pay
The sickness benefit scheme has rules regarding the qualifying period. We assist in ensuring continuous payment, handling activity requirements and documenting the need for extension beyond the ordinary period. Problem areas include conflicts regarding the employer period, graduated sick leave and transition to other benefits in the event of long-term illness.
7
Cars and aids
The scheme provides support for assistive devices and a car for people with permanent disabilities. We provide guidance on benefit criteria, assist with the application process and appeal against refusals. NAV has strict requirements for medical justification and documentation of transport needs, and many are refused benefits to which they are actually entitled.
8
Complaints handling
All NAV decisions can be appealed within time-limited deadlines to the NAV Appeals Board and possibly further to the Social Security Court. We assist with legal analysis of decisions, prepare reasoned appeals and represent in appeals proceedings. Effective appeals proceedings require knowledge of practice, evidentiary requirements and argumentation techniques that significantly increase the chances of a successful outcome.
