The probate process is often one of the most complex and conflict-ridden parts of a separation or divorce, where emotions and finances are easily mixed together. We offer assistance with private and public probates. Probate administration (such as mapping and valuation of assets) and identification of hidden assets. The Probate Act and the Marriage Act contain detailed rules for how assets should be divided, but many situations require discretionary assessments. Questions about separate property, additions to joint property, appreciation and contributions to joint value creation must be considered legally.
